  1. SUP-13-14-2013 403 & 431 E. Bellows Alan Bean, Spicer Group, acting as Interim Staff Liaison for the Planning Commission ... Bean shared the site location with the Commission, noting that the property is zoned M-2,

    Bean reported that for the applicant to move forward with the project, they needed variances for the required side street yard for open porches and a setback variance to reduce the required side yard for properties with multiple buildings on a single lot. Bean noted that these variances were granted by the Zoning Board of Appeals at their September 25, 2013 meeting

  1. Discussion on M-2 Codification Process:

    Piggott reviewed the current process and noted that although there are established standards, they are not codified in the Ordinance. Some of the concerns with this include the lack of limitations (type and area) and whether the procedures are transparent enough. There could be some confusion on what the ZBA is granting - they are not granting a variance, they are making an administrative decision on whether the applicant has met the standards.

Undoubtedly resolution requires purchase of a third opinion from the city attorney. At least the AICP 'professionals' do agree standards being authorized are not contained in the ordinance. felony misconduct
