City Confirms Intentional Misconduct

Planning Commission chair discloses the commission and Zoning Board of Appeals are not discharging their duties and responsibilities in accordance with state and local statute provisions. They have developed a 'document' of other standards, requirements, and procedures.

MI Statute 125.3502(1)(b) The zoning ordinance shall specify the requirements and standards for approving a request for a special land use.

MI Statute 125.3504(1) If the zoning ordinance authorizes the consideration and approval of special land uses or otherwise provides for discretionary decisions, the regulations and standards upon which those decisions are made shall be specified in the zoning ordinance.

City Code §154.171(A)(1) The special use shall be consistent with the intent and purpose of this chapter and the objectives of the currently adopted Master Plan.

City Code §154.171(B)(1) The Planning Commission may impose conditions to insure compliance with the standards of this chapter.

City Code §154.171(C)(1)(b) The development site plan:

City Code §154.169(D) Decisions conditionally approving or rejecting the site plans shall be based upon standards and requirements contained in the Zoning Ordinances.

MI Statute 125.3501(4) A decision rejecting, approving, or conditionally approving a site plan shall be based upon requirements and standards contained in the zoning ordinance, other statutorily authorized and properly adopted local unit of government planning documents, other applicable ordinances, and state and federal statutes.

MI Statute 125.3202(1) Amendments or supplements to the zoning ordinance shall be adopted in the same manner as provided under this act for the adoption of the original ordinance.

City officials remain unable to provide authority for their actions.
