The approval was based on compliance with ZBA requirements. State and local &lt;a href="http://bojoda.blogspot.com/p/prescribed-by-city-code.html" target="_blank"&gt;statutes&lt;/a&gt; mandate site plan approval or rejection be based upon standards and requirements contained in the zoning ordinances.&lt;/p&gt;&lt;a name='more'&gt;&lt;/a&gt;&lt;p style="margin-left: 0in; text-indent: 0.3in;"&gt;Two weeks ago, August 24, 2011, the Zoning Board of Appeals reviewed the identical site plan, ZBA Case 11-2011. Grille received liquor license approval from the city commission. Discussion indicates city staff unilaterally determined doubling hearings required was a more efficient and business friendly process.&lt;/p&gt;&lt;a name='more'&gt;&lt;/a&gt;&lt;p style="margin: 0in; text-indent: 0.25in;"&gt;This process required violating state and local statutory provisions; grounds for voiding actions of public bodies. Discussion fails to recognize violations and includes misdirection by the city attorney suggesting the process and actions were legitimate. Ordinance, Form, Publication of Summary, Public Hearing, Publication, Effective Date.&lt;br /&gt;&lt;br /&gt;&lt;div style="margin-left: 0.5in; text-indent: -0.35in;"&gt;(B) Following introduction of any ordinance, the City Clerk shall publish a summary of the proposed ordinance in a local newspaper of general circulation in the City together with a notice setting out the time and place for a public hearing on the proposed ordinance. The public hearing may not be held sooner than five (5) days after the publication. Commissioner Lux makes a point to state that it was a requirement anyways and Chairman Orlick continued to state to her that is was out of the Planning Commissions hands and would lay at the hands of the state to check on the 50% food requirements. Commissioner Lux was stating over and over that she knew darn well that this was not being looked into by the City in any way, but was told over and over that this special use request fell under the Liquor Commission for the 50%. Any violations shall be corrected within 30 days after an order to correct has been issued by the Building Official. Violations not so corrected shall automatically cancel the certificate of occupancy and compliance. Public rest room facilities shall not be considered in this determination.&lt;br /&gt;&lt;br /&gt;&lt;/div&gt;&lt;div style="margin-left: 0.6in; text-indent: -0.3in;"&gt;(d) During any given 90-day period no more than 50% of the gross revenues of the establishment shall be derived from the sale of any alcoholic liquor as defined by the Michigan Liquor Control Act. Conducting three hearings, none an enforcement decision appeal, the ZBA concluded two with postponement, and the third with authorization of variance effective only while applicant/development was not subject to the requirements. Hours of discussion is likely the least of resources expended by the ZBA, city staff and the applicants.&lt;/p&gt;&lt;p&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp; City code vests site plan review and special use permit authorization with the planning commission. The zoning board of appeals is empowered to hear and decide appeals of enforcement decisions. Had these cases been administered as &lt;a href="http://bojoda.blogspot.com/p/prescribed-by-city-code.html"&gt;prescribed by city code&lt;/a&gt; it is likely the ZBA would have avoided postponement for additional discussion of cases ZBA-13-2010 and ZBA-16-2010; and, the absurdity of authorizing variance effective if ordinance requirement is inapplicable would have been recognized, eliminating case ZBA-15-2010.&lt;/p&gt;&lt;p&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp; How much longer the city commission will foster violation of state and local statutes remains uncertain. Commenting in the July 8, 2010 Morning Sun JonJoslin indicates the city has been aware and condoning violation for six years.&lt;/p&gt;&lt;p&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp; The ZBA meeting is scheduled to be rebroadcast daily at 5 p.m., Sunday and Monday at 8 p.m. for 2 weeks. Pleasant City Code - Chapter 154:Zoning Ordinances&lt;/u&gt; is designed to ensure the community is made aware when property development may not conform to published standards and requirements.&lt;br /&gt;&lt;br /&gt;The ordinance and state statute specify the Planning Commission base site plan approval on plan conformance with published standards and requirements. The Zoning Board of Appeals is authorized to decide variance from published standards.&lt;br /&gt;&lt;br /&gt;The local ordinance provides hearing notice requirements consistent with this delegation of authority. The Planning Commission, authorized to approve site plans that conform to published standards, simply includes the site plan review hearing in its meeting agenda. Once a property has obtained a variance from a section of the zoning code, whatever standard laid forth in the variance becomes the new zoning standard for that particular parcel (not the adopted text of the zoning code). Section of 154.162(C) of the codified ordinances of the City of Mount Pleasant states &lt;i&gt;"The Zoning Board shall not have the power to alter or change the zone district classification of a property, nor make any changes in the terms of this chapter.”  &lt;/i&gt;In no manner has this section been violated as the it refers to the map and text of the zoning code and not the application of the map or text to a specific parcel. The ZBA lacks the statutory authority to amend those sections by their independent action. To amend the zoning map or text, procedures set forth under the Michigan Zoning Enabling Act (Public Act 110 of 2006) must be followed.&lt;br /&gt;&lt;br /&gt;Section 154.164 of the codified ordinances of the City of Mount Pleasant grants the ZBA the authority to grant variances. Specifically, 154.164(D) states &lt;i&gt;"The Board of Appeals shall have the power to decide applications for variances from the provisions of this chapter..." &lt;/i&gt;This is a statutory requirment of the Michigan Zoning Enabling Act (MCL 125.3603).&lt;br /&gt;&lt;br /&gt;To interpret section 154.162(C) in a manner different than explained above would result in these two sections of the zoning code being in conflict with one another. We are obviously not as educated as you because none of us can understand what the hell you are talking about.  Yes, we know you are not happy on the decisions we make and feel we are in error and most likely we are but we are going to continue to do what we do.  Trying to read your e-mails is useless and I lose interest about the 2nd paragraph every time and talking with the rest of the commissioners we all feel the same way.    Don't you ever question why we don't talk about your comments at our meetings?  We don't understand or care about you anymore as you have no bearing on anything we do now.  Here are a few helpful suggestions:&lt;o:p&gt;&lt;/o:p&gt;&lt;br /&gt;&lt;br /&gt;1.  Go away.  Meaning move out to a city or town that has an ordinance you like.&lt;br /&gt;&lt;br /&gt;2.  Change our ordinance.  Try submitting a revision of our ordinance for consideration.  Keep in mind how stupid we are so we can understand your cryptic writing.&lt;br /&gt;&lt;br /&gt;3.  Continue to waste your time sending e-mails to all of us that we don't even take the time to read anymore.  Maybe a full time job might take your mind off it or a hobby like writing a book to yourself.&lt;br /&gt;&lt;br /&gt;Just a few suggestions.
