City Commission - Illegal Closed Sessions

Effective October 25, 2010 the city of Mt. Pleasant obtained an option to purchase all or part of the state-owned property commonly known as the Mt. Pleasant Center. The Mt. Pleasant City Commission convened closed sessions to discuss the purchase at both its March 14, and March 24, 2011 regularly scheduled sessions.

March 14, 2011 Minutes (excerpt)

Mayor Kilmer added “Consider closed session pursuant to subsection 8(d) of the Open Meetings Act to discuss property acquisition” to item #17.

Moved by Vice Mayor Ling and supported by Commissioner Holton to enter into closed session pursuant to subsection 8(h) and 8(d) of the Open Meetings Act to discuss a legal opinion from legal counsel and property acquisition.

AYES: Commissioners English, Holton, Joslin, Kilmer, McGuire, Ling and Tilmann NAYS: None ABSENT: None
Motion unanimously adopted.

Pleasant, for consideration of $1.00, all or portions of certain state-owned property now under the jurisdiction of the department of community health, commonly known as the Mt. (5) If any portion of the property described in subsection (1) is not conveyed to the city of Mt. Pleasant within 180 days after the effective date of this act, the director of the department of technology, management, and budget shall take the necessary steps to prepare to convey the remaining portions of the property ...
